A resident of Tikulu village Oteno parish Apala sub county in Lira district Robert Odongo 44 years old who was sentenced to 45 years imprisonment on 5th July 2010 by the then Lira judge justice Mugenyi for murdering his wife has since appealed against the sentence of 45 years. Saying the sentence is harsh and excessive.

He appeared before the three justices headed by Kenneth Karuru, sitting in Arua court of Appeal.

It was alleged that the convict murdered his pregnant wife Achen Sylvia on her return from a local market where she had gone selling local brew and some produce.

The husband Robert Odong requested her to give him five thousand shillings but she declined prompting him to beat her up.

The lawyer representing the appellant Samuel Ondoma from Alaka and company advocates says they have appealed the sentence on grounds that their client was a first offender, he has a medical condition called hydrocele, he needed to go home to fulfill his family responsibilities and that the three years period he spent on remand were not considered. Ondoma says in their view they wanted the court to only give him 15 years.

However the state lawyer Moses Onenchan opposed their submissions and said murder carries maximum sentence of death and looking at the circumstances surrounding this case the sentence was appropriate.

He further submitted that the convict murdered his own wife who was three weeks pregnant in a brutal way and broke her limbs, inserted sticks in her private part which caused miscarriage and eventually her death meaning the convict had the intention to kill.

When the lady cried for help the in-laws came to help but the convict chased them away. Currently the appellant is 44 years old. End
