Police in Arua city are on spot for re-arresting 9 suspects released by Arua High court after courting dropping their cases many of which were capital in nature.
The release of these suspects who have been on remand from between 2021, 2022 and 2023 on Friday afternoon (April 11, 2025) caused drama between the police and the judiciary at Arua high court as the police failed to agree to the ruling made by the Judge Justice David Batema to drop the charges against the 9 suspects.
The joint police comprising of the field force unit and Rapid Response unit police headed by the police field operations commander of Arua later rearrested the 9 released suspects.
A relative of one of the rearrested suspect only identified as Faridah expressed disappointment over the action of the police to disregard the ruling of the court. “The way they arrested them was not good actually, they were from there the judge had released them if there was a problem the police should have gone to the judiciary,” Faridah lamented.
The nine rearrested suspects included, Mungufeni Shafik charged of attempted murder under CRB: 934/2023, Andama Fred attempted murder case file CRB 984/2023: together with Basiga Sipla, Mawa Suleiman, Twezikana Fred and Azak Nabil, Brian Nabaasa charged with aggravated Robbery case file CRB: 178/2023, Abdul Aziz charged with Rape case file CRB: 393/2023 and Agotre Charles charged of Defilement case file CRB: 750/2022.
West Nile Regional Police spokesperson SSP. Collins Asea while responding to the media confirmed the re-arrest of the released suspects on the orders from the office of the Directorate of Public Prosecution in Kampala.
“We got advise from DPP Kampala to arrest the suspects and currently, they are in police custody we shall resubmit their file back to the same court”, SSP. Collins confirmed.
Meanwhile Kasoke Rasul the senior legal officer at Uganda Law Society who represented the caused suspects termed the action of the police as undermine to the court orders.
“The state attorneys chose to abscond themselves in court and they did not inform the court that they are having some meeting and since they are not interested, we requested court to dismiss the cases of course court agreed, we are wondering how the police is arresting those people without charges been sanctioned against them,” Kasoke said.
