Arua chief magistrate’s court with costs dismissed a case filled by Ezra Yabia against Mike Agondua and another Richard Andama over the kingship of Ayivu.
The complainant prayed that a judgment be entered against the defendants jointly and severally that Mike Agondua is not chief of Ayivu and the second defendant is not the prime minister of Ayivu since the Ayivu community chiefdom has never instituted and installed a chief since time memorial and also a permanent injunction restraining the defendants, their agents servants and successors in title form from holding and presenting the defendants as the chief or king of the Ayivu people and the prime minister respectively.
However the chief magistrate Daniel Lobuwa ruled that the case was premature and referred them to council of elders or its equivalent to resolve the matter before the matter comes to court under section 16 of institution of traditional leaders.
The accused person Mike Agondua welcomed the ruling.
Meanwhile the lawyer reprehending the plaintive Samuel Ondoma from Alaka and company advocates said they will appeal the magistrates ruling and also fill the same case in high court.
The chief magistrate ordered the plaintive to pay costs and was also advised to go and resolve the matter within the cultural structures. End
